Terms of Service

These Terms of Service ("Terms") govern access to and use of PayBackMD — the platform, website, and related services operated by PayBackMD ("we," "us"). By creating a practice account or claiming a refund through PayBackMD, you agree to these Terms.
The service
PayBackMD enables medical practices to deliver refunds owed to their patients digitally. Practices create and approve refunds; patients receive a secure link to verify their identity and choose how to receive their money (for example, direct deposit or a mailed check). Payment processing is performed by our regulated payment processing partner; PayBackMD is not a bank.
Practice accounts
- Practices are responsible for the accuracy of refund and patient information they submit, and for having appropriate consent to share it with us for refund delivery.
- Account credentials must be kept confidential; practices are responsible for activity under their accounts.
- Fees for the service are disclosed to the practice and may be updated with notice.
Patient refund claims
- Refund links are personal. Identity verification (such as date of birth) is required before a refund can be claimed.
- Unclaimed refunds may expire after the period set by the issuing practice, after which the patient should contact the practice directly.
- Banking details entered while claiming a refund are collected directly by our payment processor and are not stored by PayBackMD.
Text messaging terms
By providing a mobile number to your medical practice, you consent to receive transactional text messages about refunds issued to you through PayBackMD. Message frequency varies with account activity — typically one notification per refund plus periodic reminders until the refund is claimed or expires. Message and data rates may apply. Reply HELP for help or STOP to cancel at any time. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.
Acceptable use
You may not misuse the service — including attempting to claim refunds not issued to you, probing or disrupting the platform's security, or submitting false information. We may suspend accounts that violate these Terms.
Disclaimers and liability
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, PayBackMD's aggregate liability arising out of the service is limited to the fees paid to us by the applicable practice in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.
